These terms and conditions of sale (“Terms and Conditions”) must be accepted and agreed by every Client (“Client”) of 130 Evergreen Spa LLC, operating as Evergreen Spa (“Evergreen Spa,” “Company,” “we,” or “us”). By making a booking with us, all Clients are deemed to have read, understood, and agreed to these Terms and Conditions.

Definitions

“Private Spa Suite” shall refer to any of our three privately rented spa suites (Pine, Willow and Oak) each available for booking for a set duration of time.

“Massage Services” shall refer to any hands-on massage treatment rendered by our licensed massage therapists in our dedicated massage rooms.

“Products” shall refer to any tangible merchandise offered by us for sale, including but not limited to lotions, oils, and other wellness or personal care products.

“Services” shall refer collectively to Private Spa Suite rentals, Massage Services, and any other service offered by Evergreen Spa.

“Client” shall refer to any individual making a booking or purchasing a product from Evergreen Spa.

Client Representations

Client represents and warrants to Evergreen Spa that:

  • Client is over the age of eighteen (18) and has the power and authority to enter into and perform Client’s obligations under these Terms and Conditions.
  • All information provided by Client to Evergreen Spa is truthful, accurate, and complete.
  • Client is the authorized signatory of the credit or debit card provided to Evergreen Spa to pay for Services and Products.
  • Client shall comply with all Terms and Conditions and all spa rules communicated at the time of booking or upon arrival.
  • Client has provided and will provide accurate and complete booking information, including, without limitation, Client’s legal name, contact information, and the number of guests in their party.

Warranties and Service Guarantees

Private Spa Suites and Massage Services: Evergreen Spa will provide all booked Services in a professional and hygienic manner. Given that the experience of spa services and massage therapy may vary depending on the individual, including one’s physical and/or mental state of health, we are not able to guarantee any specific results or outcomes from our Services.

Products: We provide a one-week defect-free guarantee for all products sold. We will replace a defective product with an identical product if it is proven to be defective, provided that the defective product is returned to us within one (1) week from the date of purchase together with the relevant receipt. Where we are unable to replace the defective product with an identical product, we will refund the amount paid by the Client in full within two (2) weeks from the date the defective product is returned.

Health, Allergies, and Special Considerations

The Services provided by Evergreen Spa are intended for general wellness and relaxation purposes only and are not intended to substitute professional medical treatment for any condition, medical or otherwise.

Clients with any existing medical conditions, allergies, physical limitations, or who are pregnant are advised to consult their physician before booking or receiving any Services. You are required to disclose any health conditions, limitations, allergies, physical ailments, and/or pregnancy status in your booking request. You must also notify your therapist or spa host immediately of any discomfort experienced during your visit.

Evergreen Spa reserves the right to decline or discontinue Services to any Client whose health condition, behavior, or physical state may pose a risk to themselves, other guests, or our staff.

You agree to fully indemnify and hold harmless 130 Evergreen Spa LLC, its affiliates, representatives, agents, employees, and contractors from and against all liabilities, claims, expenses, damages, and losses, including legal fees, arising out of or in connection with the Services or Products provided to you.

Payment Methods and Booking Policy

Full payment is due at the time of booking. No booking is confirmed until payment in full has been received. We accept the following methods of payment:

  • Cash
  • Major credit and debit cards: Visa, Mastercard, and American Express

An electronic receipt acknowledging payment will be issued within three (3) business days from request.

Cancellation and Rescheduling Policy

Evergreen Spa maintains the following cancellation and rescheduling policy in order to provide the best possible experience to all of our guests:

Cancellation more than 24 hours before your booking: You are entitled to a full refund of the amount paid. To receive a full refund, cancellation must be submitted in writing (email or through our booking platform) at least 24 hours prior to the original scheduled start time of your reservation.

Cancellation within 24 hours or No-Show: If you cancel within 24 hours of your reservation or fail to show up for your booking without prior notice, you will forfeit 50% of the total amount paid. The remaining 50% will be refunded to the original payment method within five (5) to ten (10) business days.

Rescheduling: Requests to reschedule a booking must be submitted at least 24 hours prior to the original reservation time. Rescheduling is subject to availability and cannot be guaranteed. If rescheduling is not available, standard cancellation terms apply.

Cancellation by Evergreen Spa

On rare occasions, Evergreen Spa may need to cancel a confirmed booking. We will notify you as soon as possible and offer either an alternative booking of equivalent or greater value, or a full refund of the amount paid. We regret that we cannot pay compensation or reimburse any additional expenses or costs you may incur as a result of such cancellation.

Exchanges and Refunds

Private Spa Suite and Massage Bookings: As payment in full is collected at the time of booking, refunds are governed by the cancellation policy set out above. We do not provide refunds for Services once a session has commenced. No refund will be issued once you have entered your reserved spa suite or massage room and your session has begun.

Products: Products may be returned for a full refund within one (1) week of purchase, provided they are unused, in their original condition and packaging, and accompanied by proof of purchase. We do not provide refunds for products that have been opened or used unless they are proven to be defective.

Professional Standards

Evergreen Spa is a professional luxury wellness establishment. We maintain the highest standards of professionalism, dignity, and respect for all guests and staff. We strictly prohibit the solicitation or provision of sexual services of any kind, whether requested by guests or otherwise. Any such request or inappropriate behavior will result in the immediate termination of the session without refund and will be reported to the appropriate authorities.

Evergreen Spa reserves the right to refuse service to, or remove from the premises, any guest who behaves in a disrespectful, disruptive, or inappropriate manner toward staff, other guests, or the spa environment.

Private Spa Suite Usage and Occupancy

Private Spa Suites are available in three sizes: Pine (up to 4 guests), Willow (up to 6 guests), and Oak (up to 8 guests). Occupancy limits are strictly enforced. Clients may not exceed the maximum occupancy of their reserved suite.

Spa suites are rented for a fixed duration of time as agreed at the time of booking. Clients must vacate the suite at the conclusion of their reserved time slot. Requests for additional time are subject to availability and will be charged at the applicable hourly rate.

Clients are responsible for the condition of their reserved suite during their rental period. Any damage to spa equipment, pools, saunas, fixtures, or furnishings caused by guests during their rental period may result in additional charges.

Outside food and beverages may not be brought into the spa suites unless pre-approved by Evergreen Spa. Glassware and any items that may pose a safety hazard in wet or sauna environments are not permitted.

Data Security and Privacy

Evergreen Spa will obtain your consent prior to any use of your personal information for marketing purposes. For more information, please refer to our Privacy Policy at www.evergreenspa.com/privacypolicy and our Terms of Use at www.evergreenspa.com/termsofuse.

Force Majeure

Evergreen Spa cannot accept responsibility or pay any compensation where the performance of Services is prevented or materially affected by circumstances beyond our reasonable control. Such circumstances include government-mandated shutdowns, damage to or destruction of spa premises through fire, flood, explosion, storm, break-in, criminal damage, riots, civil strife, industrial action, natural disaster, pandemic, epidemic, war, actual or threatened terrorist activity, or any other similar event outside our control.

Entire Agreement

These Terms and Conditions constitute the sole and entire agreement between you and Evergreen Spa regarding the booking of Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the booking of Services.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York. Any dispute arising from or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the state or federal courts located in Kings County (Brooklyn), New York.

Changes to Terms and Conditions

Evergreen Spa reserves the right to revise these Terms and Conditions at any time in its sole discretion. The revised Terms and Conditions will be posted on our website at www.evergreenspa.com. Your continued use of our Services following any revision constitutes your acceptance of the updated Terms and Conditions.
