Terms of Sale

These Terms of Sale (“Terms”) govern all purchases of products and beverages made at Evergreen Spa, operated by 130 Evergreen Spa LLC (“Company,” “we,” or “us”), whether purchased in person at our location at 130 Evergreen Avenue, Brooklyn, NY 11206, or through our website at https://www.evergreenspa.com. By making a purchase, you agree to these Terms.

These Terms of Sale are incorporated into and must be read together with our Terms of Use (www.evergreenspa.com/termsofuse), our Terms and Conditions for Booking (www.evergreenspa.com/termsofsale), and our Privacy Policy (www.evergreenspa.com/privacypolicy).

Products and Beverages Available for Purchase

Evergreen Spa offers the following categories of items for sale:

  • Wellness Products: Lotions, oils, and other personal care and wellness products available for retail purchase in the spa.
  • Non-Alcoholic Beverages: Water, juices, teas, and other non-alcoholic drinks available for purchase during your visit.
  • Alcoholic Beverages: A selection of alcoholic beverages available for purchase by eligible guests during their visit, subject to the alcohol purchase requirements below.

Product availability may vary. Evergreen Spa reserves the right to modify, add, or discontinue any product or beverage offering at any time without prior notice.

Pricing and Payment

All prices are listed in U.S. dollars and are inclusive of applicable taxes unless otherwise stated. Prices are subject to change without notice. The price charged at the time of purchase is final.

We accept the following methods of payment:

  • Cash
  • Major credit and debit cards: Visa, Mastercard, and American Express

A receipt will be provided upon request for all in-person purchases. For online purchases, an electronic receipt will be issued to the email address provided at checkout.

Alcoholic Beverage Sales — Age Verification and Compliance

The sale of alcoholic beverages is strictly governed by New York State law. By purchasing or attempting to purchase an alcoholic beverage at Evergreen Spa, you represent and warrant that you are 21 years of age or older.

Evergreen Spa complies fully with the New York State Alcoholic Beverage Control Law. The following rules apply to all alcoholic beverage purchases:

  • Age Verification: Valid government-issued photo identification proving that you are 21 years of age or older is required for the purchase of any alcoholic beverage. We reserve the right to request ID from any guest at any time. Acceptable forms of ID include a valid U.S. driver’s license, U.S. passport, or state-issued ID card.
  • Refusal of Sale: Evergreen Spa reserves the right to refuse the sale of alcohol to any person who: (a) cannot produce valid ID proving they are 21 or older; (b) appears to be intoxicated; or (c) is purchasing on behalf of a minor or an intoxicated person.
  • No Service to Minors: We will not sell or provide alcoholic beverages to any person under the age of 21 under any circumstances. Guests who are found to have provided alcohol to a minor will be immediately removed from the premises.
  • Responsible Service: Evergreen Spa reserves the right to limit the quantity of alcoholic beverages sold to any individual guest and to stop service at any time at our sole discretion.
  • Consumption on Premises: Alcoholic beverages purchased at Evergreen Spa are intended for consumption on our premises only and may not be removed from the spa.

Violation of any of the above alcohol policies will result in immediate removal from the premises without refund.

Wellness Product Sales

All wellness products including lotions, oils, and personal care items are sold as-is with the manufacturer’s original labeling and ingredients list. Evergreen Spa makes no medical claims regarding any product sold. Products are intended for general personal care and wellness use only.

Clients with known skin sensitivities, allergies, or medical conditions are advised to review product ingredients carefully before purchase and consult a healthcare provider if necessary. Evergreen Spa is not liable for any adverse reactions resulting from the use of products purchased at our spa.

Returns, Exchanges, and Refunds

Wellness Products: Unopened wellness products in their original condition and packaging may be returned for a full refund within four (4) days of purchase, accompanied by proof of purchase. We do not accept returns on opened or used products unless they are proven to be defective. Defective products will be replaced with an identical item or refunded in full within fourteen (14) days of the defective item being returned to us.

Beverages: All beverage sales are final. We do not offer refunds or exchanges on beverages once purchased, except where the beverage is proven to be spoiled or otherwise unfit for consumption, in which case we will replace it immediately.

How to Initiate a Return: To initiate a return or report a defective product, please contact us at info@evergreenspa.com or speak with a staff member in person. Please include your proof of purchase and a description of the issue.

Personal Use Only — No Resale

All products and beverages purchased at Evergreen Spa are for personal use only. Resale of any product purchased at Evergreen Spa is strictly prohibited. Evergreen Spa reserves the right to limit quantities purchased per guest.

Limitation of Liability

To the fullest extent permitted by applicable law, 130 Evergreen Spa LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the purchase or use of any product or beverage sold at Evergreen Spa. Our total liability for any claim arising from a product purchase shall not exceed the original purchase price of the product in question.

Nothing in these Terms of Sale excludes or limits our liability for death or personal injury caused by our negligence, or for any matter which it would be illegal to exclude or restrict.

Governing Law

These Terms of Sale shall be governed by and construed in accordance with the laws of the State of New York. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the state or federal courts located in Kings County (Brooklyn), New York.

Changes to These Terms

Evergreen Spa reserves the right to update or modify these Terms of Sale at any time. The revised Terms will be posted at www.evergreenspa.com/termsofsale with an updated “Last Modified” date. Your continued purchases following any revision constitute acceptance of the updated Terms.
